This Privacy Policy Statement (this “Privacy Policy”) discloses the privacy practices for personal information collected by, or submitted to, Timbers Resorts, or any affiliates of Timbers Resorts (together, “Timbers,” “we,” “us” or “our”). In the event this Privacy Policy conflicts with any applicable law or any other agreement between you and Timbers, such applicable law or other agreement shall govern.

If you do not wish to provide us information that we request, please do not provide us such information understanding that without such information, we may be unable to provide you with information and services. Furthermore, while we have implemented standard security measures to protect the transmission of personal information, no transmission of data through electronic means is guaranteed to be completely secure and therefore we cannot guarantee the security of any information you provide to us.

Collection and Use of Information

Timbers collects personal information that you provide through the Internet, email, mail, facsimile, telephone or otherwise. Timbers is the owner of the information collected from you. We will not sell or rent this information to any third party unaffiliated with Timbers without your consent; except that we may share your personal information with third parties that (1) help manage our databases, customer lists and email lists; (2) allow us to provide special offers (including offers through corporate partners) or other information to you; (3) help us perform our contractual obligations to you; or (4) have a right to such information pursuant to applicable laws or court orders.

We will use personal information collected to provide you with information from us, including sales and marketing materials, and to address matters raised in any communications that you may have with us.

By submitting information to us, you agree to receive communications from Timbers, including communications from some or all developers of the several real estate projects affiliated with Timbers. We will not send you communications if you have notified the sender of such communications of your preference not to receive such communications, or when we are prohibited by applicable law from doing so.

If you are a resident of a country outside the U.S., then by your submission of information to us, you understand, acknowledge and agree that your information will be transferred to databases maintained in the U.S., which databases are subject to U.S. law and may provide different levels of data protection than countries outside the U.S.

Certain Other Forms of Information Collected on the Internet

Use Data: If you use our internet sites, we may collect non-personally identifiable information about your use of the sites (such as IP addresses, domains, browser type and version, and operating system).

Cookies: A cookie is a small file stored on a user’s computer that contains information about the user. When using our internet sites, we may use either session ID cookies and/or persistent cookies. A session ID cookie terminates once a user closes the browser. A persistent cookie is a small text file stored on a user’s hard drive for an extended period of time. By showing how and when you use our sites, cookies help in targeting information based on your interests. Cookies also allow us to store the personal preferences that you set during each visit to our sites, which in turn allows us to speed up your future activities at our sites. You may also, upon request, (1) view data we have about you, if any; (2) change or correct any data we have about you; (3) have us delete any data we have about you; and/or (4) express any concerns you have about our use of your data.

Timbers may amend this Privacy policy at any time in its sole discretion, subject to any applicable laws. Please review this Privacy Policy periodically to confirm your continued agreement with the terms contained herein, as the same may be amended from time to time.
